What's Changed?
Employers are now legally obligated to put reasonable measures in place to prevent sexual harassment in the workplace. The EHRC has published guidance on the minimum standards expected which include, but are not limited to:
- Anti-harassment/prevention of sexual harassment training (every 6 months)
- Conducting risk assessments focused on identifying risks of sexual harassment
- Anti-harassment policy
- Administering anonymous Employee Surveys to identify risks and previous/current harassment.
Employers who fail to comply with their legal obligations can face enforcement action from the EHRC, and any successful claims of sexual harassment at court may be subject to 'up to 25%' increase of awards. Not just in relation to sexual harassment claims, but any successful harassment claims brought alongside the existing sexual harassment claim also.
